State Law Governing River Port Districts

(Sections 6800-6, Harbors and Navigation Code)

The Sacramento-Yolo Port Commission is composed of five members, with four appointed by the City Council of the City of West Sacramento and the remaining one commissioner appointed by the Board of Supervisors of Yolo County (6830.1).

The boundaries of the Sacramento-Yolo Port District are established to coincide with the first supervisorial district of the County of Yolo, as October 1, 2005. The boundaries also include all property owned by the Sacramento-Yolo Port District in Solano County that was incorporated into the district by the Sacramento County Local Agency Formation Commission on May 29, 1992 (6830.2).

The powers of a river port district are exercised by its board, through ordinance of resolution passed by a majority vote (6860). The board of the Sacramento-Yolo Port District cannot sell or dismantle the Deepwater Channel or the North Terminal Property without the prior consent of the City of Sacramento, the county of Sacramento, and the County of Yolo. In addition the board cannot sell or lease for non maritime purposes, land in excess of 10 aces located north of Southport Parkway and west of Lake Washington, unless, prior to executing a sale or lease, the board makes a written finding, based on substantial evidence in the record, that the proposed sale of lease is necessary to maintain the financial viability of the port (6894.1). A district may acquire, purchase, takeover, construct, maintain, operate, develop and regulate wharves, docks, warehouses, grain elevators, bunkering facilities and other facilities necessary for the operate and development of its ports and waterways (6895).

A river port district can also exercise the right of eminent domain to take any property necessary or convenient to carry out any of its purposes (6896). However, the Sacramento-Yolo Port District may not exercise the power of eminent domain in the County of Sacramento, the City of Sacramento, the County of Yolo or the County of Solano, without specific authorization from each respectively. The Sacramento-Yolo Port District does, on the other hand, have the power to exercise eminent domain in within the boundaries of the City of West Sacramento (6910).
