Program Information
More than 48 million reusable and waste tires are generated each year in California. About 50,000 waste tires are already stockpiled throughout the state, posing a health and safety risk for the public. Requirements for the storage and disposal of waste tires are intended to address potential fire and health risks posed by the increasing number of waste tires.
The California Tire Recycling Act passed in 1989. The California Department of Resources Recycling and Recovery (CalRecycle) is mandated to regulate and manage waste tires within the state. The waste tire program requires generators of waste tires who contract with registered waste tire haulers to post a Tire Program ID certificate at the facility, and to retain complete and accurate waste tire manifests from registered waste tire haulers. Anyone transporting 10 or more waste tires is required to register tire hauling vehicles with CalRecycle. Facilities that store large quantities of waste tires (usually more than 500) are required to obtain a permit from CalRecycle and comply with specific storage standards.
Generators, transporters and accumulation facilities in Yolo County are subject to routine inspections by Yolo Environmental Health, the Local Enforcement Agency. Facilities found in violation of the requirements are issued a Notice of Violation specifying the corrections required and a time frame in which they must comply. Those that fail to come into compliance may be referred to CalRecycle for possible additional enforcement action to obtain compliance. Disposal of waste tires on private lands or public highways is an infraction that, upon conviction, will result in penalties of not less than $200 or greater than $2,000. However if commercial quantities are disposed, the violation becomes a misdemeanor that is punishable by up to 6 months in county jail and a fine. Penalties and fines for facilities that accumulate, transport, process or dispose of waste tires can be substantial, reaching as much as $10,000 per day, per violation.
